Swimming Pool Accidents

Swimming pools provide hours of fun, relaxation, exercise and great memories. However, when negligence is involved, injuries can happen quickly and be life threatening. 
 
According to the Centers for Disease Control and Prevention, from 2005-2014, there was an average of 3,536 fatal unintentional drownings annually in the U.S. This equates to about 10 deaths per day. Drowning is also the leading cause of unintentional deaths and injuries in early childhood years.
 
When individuals drown there is often no one else to blame, but in some cases – often those of a child drowning in a swimming pool – the pool’s owner or operator could be held liable if they have ignored basic safety protocols and local laws regulating swimming pools both public and private.
 
Proving the Liability of Pool Owners
 
A pool owner or operator can be found to be negligent if he or she fails to meet their duty of care. To keep pools safe, they must be properly maintained to ensure that any ladders, diving boards, and slides are held securely, steps aren’t chipped, shallow ends are marked and deep ends aren’t shallow.
 
While all pool owners or operators must maintain the pool safely and warn guests of any existing dangers, this duty is measured differently dependent upon whether it is a public or private pool.
 
A pool owner breaches their duty by failing to adhere to applicable safety ordinances, failing to adequately secure the pool area as required or failing to properly supervise users. You may require a swimming pool accident attorney if:

  • Inadequate markers of water depth

  • Overcrowding
  • Drain entrapment
  • Inattentive/incompetent lifeguards
  • Poor lighting
  • Pool design/building violations
